Associate General Counsel- Regulatory and Compliance is a key team member in the Office of the General Counsel reporting to and performing services under the direction of the Senior Vice President and General Counsel for VCU Health System. This role provides legal advice and counsel in compliance with state and federal regulations. The Associate General Counsel- Regulatory and Compliance is responsible for ensuring VCU Health System is compliant with state and federal laws and regulations related to healthcare including, but not limited to, state and federal fraud and abuse laws (i.e. Anti-kickback Statute, Stark, Civil Monetary Penalties Law, False Claims Act), licensing and accreditation, HIPAA/HITECH, EMTALA, digital health, telehealth/telemedicine, medical staff/peer review issues, healthcare compliance matters, billing, reimbursement and claims issues (to include Medicare/Medicaid).
Essential Job Statements
- Provide legal counsel to healthcare providers on a wide range of issues, including regulatory compliance, fraud and abuse, data privacy and security, licensing/accreditation, reimbursement, and medical staff/peer review related matters.
- Analyze complex healthcare laws and regulations and provide guidance to VCU Health leaders to implement and maintain a strong compliance environment.
- Advise on relevant federal and state laws, including but not limited to fraud and abuse laws (i.e. Anti-kickback Statute, Stark, Civil Monetary Penalties Law, False Claims Act), licensing and accreditation, HIPAA/HITECH, EMTALA, digital health, telehealth/telemedicine, medical staff/peer review issues, healthcare compliance matters, billing, reimbursement and claims issues (to include Medicare/Medicaid).
- Research the impact of proposed and new rules, regulations, and legislation and advise the VCU Health leadership on appropriate mitigation strategies and/or response.
- Assist with various projects and initiatives to meet regulatory goals and help the VCU Health address any compliance risks.
- Anticipates and mitigates potential legal risks and developing strategies to avoid costly litigation and/or enforcement action.
- Keeps informed of industry-specific regulations and ensuring that appropriate risk management strategies are in place.
- Oversees projects and works with outside agencies engaged to assist VCU Health to include the review, direction, and supervision of any outside counsel or agency’s legal work.
- Works collaboratively with the paralegals and other attorney and non-attorney staff assigned to work on specific projects throughout VCU Health.
- Ensures responsibility and visible commitment of diversity equity and inclusion strategy, programs, and initiatives through collaboration and implementation of initiatives across the health system.
- Performs other duties as assigned and/or participates in special projects in order to support the mission of VCUHS and department.
Employment Qualifications
Required Education:
Juris Doctor (JD) degree from a US accredited law school is required.

Candidate must be eligible for admission to the Virginia State Bar.

Years and Type of Required Experience
A minimum of 5 years of legal work experience with a law firm or in-house legal department preferably performing legal services for hospitals, health systems, or integrated delivery systems.

- Experience drafting, revising, reviewing, and negotiating employment-related agreements including employment agreements and separation agreements.
- Ability to identify risk, problem solve, and offer creative solutions to mitigate risk.
- Ability to work collaboratively as a member of a lean team, while empowering business leaders and colleagues and emphasizing accountability.
- Experience managing outside counsel and supporting e-discovery and related matters.
- Strong business acumen and excellent project management, collaboration, and problem-solving skills.
- Ability to manage and prioritize a large volume of concurrent projects.
