Job Description
Under general direction of the Legal & Business Affairs department, the Senior Attorney, Marketing is responsible for (1) drafting, negotiating and interpreting contracts, letter agreements and other legal documentation for advertising and marketing services and projects, digital services and media, social media and influencer marketing; and (2) reviewing marketing materials and managing regulatory, statutory, and contractual compliance requirements.
ESSENTIAL DUTIES AND RESPONSIBILITIES:
- Provide general legal support for the marketing, sales, digital communications, and content creation teams, including but not limited to intellectual property rights clearance (i.e., music, talent, clips/images), rights of publicity, trademark, copyright, user generated content, sweepstakes and promotions, and interpretation and application of U.S. laws and regulations with respect to false and deceptive practices, consumer protection, data collection and direct-to-consumer marketing.
- Negotiate, draft and interpret complex business contracts across a broad range of advertising, marketing and sales initiatives, including influencer marketing, social media, digital marketing and advertising, contests and promotions, television and film productions, marketing, consulting, creative and related technology services agreements; provide advice on regulatory and contractual compliance obligations; and provide support for dispute resolution with contracted parties, termination of contracts and other litigation support as assigned.
- Assist with drafting policies and procedures and development of training surrounding regulatory and statutory compliance obligations and contractual requirements with a focus on advertising and consumer protection issues.
- Manages special projects, monitors international and U.S. policies, regulations, legislation laws pertaining to consumer marketing and advertising in travel and tourism industry, digital media, e-commerce.
- Perform other duties as assigned.
Qualifications
- Strong understanding of marketing and consumer protection laws, with at least 5 years’ experience in social media and digital marketing, and the legal requirements, both domestic and international.
- Strong understanding of intellectual property law, including trademark and copyright, rights of publicity, and clearance.
- Proficient understanding of data protection and data privacy legal issues, both domestic and international.
- Substantial contract drafting experience in complex services and license agreements.
- Strong written and verbal communication and interpersonal skills.
- Strong prioritization and time management skills.
- Must be a self-starter capable of working with various elements within a diverse organization to provide the highest level of service.
- The ability to work independently with minimal supervision is required.
- Integrity, honesty and trust and the ability to maintain strict confidentiality are also imperative to this role.
EDUCATION: Master’s degree, Juris Doctor required from an accredited law school.
CERTIFICATIONS, LICENSES, REGISTRATIONS: California State Bar registration required.
EXPERIENCE:
- At least 5 years’ post-law school experience, as an attorney, preferably with top-tier law firm or corporate legal department.
- At least 5 years’ in-house experience advising clients on intellectual property rights, consumer protection, marketing, advertising, and rights clearance.
- At least 5 years’ experience interpreting, negotiating, and drafting complex commercial transactions.
- Experience with social media, digital marketing and intellectual property strongly preferred.

- Proven ability and commitment to work both independently and collaboratively with numerous people at all levels throughout the company.
- Demonstrated ability, in a positive, commercial and practical manner, to identify, prioritize and resolve issues quickly and effectively.
- Must be highly proficient in Microsoft Word, Excel, PowerPoint as well as Internet and web-based training tools
- Hybrid: This position has been designated as hybrid, generally contributing from the office a minimum of three days per week.
